Welcome to ASPECTO.

These Terms of Service (“Terms”) govern your access to and use of the ASPECTO website, online store, products, custom design tools, and related services (collectively, the “Services”).

The terms “we”, “us”, and “our” refer to ASPECTO.

Our online store is powered by Shopify, which provides the e-commerce infrastructure that enables us to offer the Services to you.

By accessing our website or placing an order, you agree to these Terms, together with our Privacy Policy and Refund Policy.

Nothing in these Terms is intended to limit or exclude any mandatory rights granted to consumers under Greek or European Union law.

SECTION 1 — ACCESS AND ACCOUNTS

You must use the Services only for lawful purposes.

When placing an order or creating an account, you agree to provide accurate, current, and complete information, including your contact, billing, payment, and shipping information.

You are responsible for maintaining the confidentiality of your account credentials and for activity carried out through your account.

Customer accounts are optional unless otherwise indicated during checkout.

SECTION 2 — PRODUCTS

We make reasonable efforts to ensure that product descriptions, photographs, colors, dimensions, and other information displayed on our website are accurate.

However, actual colors may vary slightly due to differences in screens, device settings, lighting, printing methods, and material characteristics.

Minor variations that are inherent to production or printing do not necessarily constitute defects.

Nothing in this section affects your statutory rights where a product is defective, damaged, or does not conform to the contract.

We reserve the right to modify or discontinue products and to limit quantities where reasonably necessary.

SECTION 3 — CUSTOM-DESIGNED PRODUCTS

Certain ASPECTO products are made to the customer's individual specifications using images, artwork, photographs, or designs uploaded through our custom case builder.

Custom-designed products are manufactured specifically for the customer and may therefore be excluded from the statutory 14-day right of withdrawal where the applicable legal requirements for personalised goods are met.

Further details are provided in our Refund Policy.

This exclusion does not affect your statutory rights if a custom product is defective, damaged, incorrectly produced, or otherwise does not conform to your order.

SECTION 4 — CUSTOMER-UPLOADED CONTENT

When uploading artwork, images, photographs, logos, graphics, or other material through our custom case builder, you confirm that:

You own the content or have all necessary rights and permissions to use it.
Its use does not infringe any third-party intellectual property, privacy, publicity, or other legal rights.
The content does not violate applicable law.

You grant ASPECTO a limited, non-exclusive license to use, process, reproduce, and transmit uploaded content only as reasonably necessary to:

Generate your custom design.
Manufacture and fulfil your order.
Provide customer support.
Handle quality issues, reprints, complaints, or disputes relating to your order.

We will not use customer-uploaded designs for unrelated commercial purposes without permission.

We reserve the right to reject or cancel a custom order where the uploaded material is unlawful, clearly infringes third-party rights, or cannot reasonably be produced.

SECTION 5 — ORDERS

Submitting an order constitutes an offer to purchase the selected products.

An order is accepted when we confirm it in accordance with our order-processing procedures and successfully process the applicable payment.

We reserve the right to refuse or cancel an order where reasonably necessary, including in cases of:

Payment failure.
Suspected fraud.
Incorrect pricing caused by an obvious technical or administrative error.
Product unavailability.
Unlawful or infringing uploaded content.
An inability to fulfil the order.

If we cancel an order after payment has been collected, any applicable amount paid will be refunded.

Please review custom orders carefully before submitting them. Because production may begin shortly after acceptance, cancellation may not be possible once production has started.

This does not affect any mandatory rights available to you under applicable law.

SECTION 6 — PRICES AND VAT

All prices displayed on our store are in Euros (€).

Unless otherwise clearly stated, prices displayed to consumers include applicable VAT.

Any delivery charges or other applicable costs will be shown before you complete checkout.

Prices may change from time to time, but changes will not affect orders already accepted.

SECTION 7 — PAYMENT

You agree to provide accurate and authorised payment information.

Payments may be processed by Shopify and third-party payment service providers.

We do not normally receive or store full payment card details directly.

An order may not be fulfilled until the required payment has been successfully authorised or received.

SECTION 8 — SHIPPING AND DELIVERY

ASPECTO currently ships to addresses within Greece unless otherwise stated on our website.

Available shipping methods, delivery charges, and estimated delivery times are displayed during checkout.

Delivery times are estimates and may be affected by circumstances outside our reasonable control.

Where we arrange delivery to you, the risk of loss of or damage to the goods passes to you when you, or a third party designated by you other than the carrier, physically receive the goods, except where applicable law provides otherwise.

If a shipment is delayed, lost, or damaged before delivery, please contact us so that we can investigate the matter with the courier.

Nothing in this section limits any mandatory consumer rights relating to delivery.

SECTION 9 — RETURNS, WITHDRAWAL AND REFUNDS

Returns, statutory withdrawal rights, custom-product exclusions, refunds, and damaged or defective products are governed by our Refund Policy.

Where a statutory right or remedy applies under Greek or European Union consumer law, that right is not restricted by these Terms.

SECTION 10 — CONFORMITY AND STATUTORY CONSUMER RIGHTS

We are responsible for delivering goods that conform to the sales contract as required by applicable consumer protection law.

If a product is defective or does not conform to the contract, you may be entitled to remedies provided by Greek and European Union law.

These statutory rights exist independently of any voluntary commercial guarantee that may be offered.

Nothing in these Terms excludes or limits rights that cannot legally be excluded or limited.

SECTION 11 — INTELLECTUAL PROPERTY

Unless otherwise indicated, the ASPECTO website and its original content, branding, logos, graphics, photographs, product designs, text, videos, and other materials are owned by or licensed to ASPECTO and are protected by applicable intellectual property laws.

You may use the website for personal, non-commercial purposes.

You may not reproduce, distribute, modify, republish, commercially exploit, or otherwise use our protected material without prior permission, except where permitted by law.

Customer-uploaded content remains subject to Section 4.

SECTION 12 — THIRD-PARTY SERVICES AND LINKS

Our Services may contain functionality, services, or links provided by third parties, including Shopify, payment providers, shipping companies, hosting providers, and other technology providers.

Third-party services may be subject to their own terms and privacy policies.

We are not responsible for the independent operation or content of third-party websites that we do not control.

Nothing in this section excludes any liability that cannot legally be excluded.

SECTION 13 — SHOPIFY

Our online store is powered by Shopify.

Purchases made from the ASPECTO store are transactions between you and ASPECTO, not between you and Shopify.

Shopify provides infrastructure and technology that support the operation of the store and may process certain information as described in our Privacy Policy and Shopify's applicable privacy information.

SECTION 14 — PRIVACY

Our processing of personal information is governed by our Privacy Policy.

Please review our Privacy Policy for information about how we collect, use, store, and disclose personal information, including information uploaded through our custom case builder.

SECTION 15 — REVIEWS AND FEEDBACK

If you voluntarily submit a product review, suggestion, or other feedback to us, you confirm that you have the right to submit that content.

You grant us a non-exclusive, royalty-free license to use and display such feedback for legitimate business and promotional purposes, subject to applicable law.

We will not claim ownership of your underlying intellectual property merely because you submit feedback.

SECTION 16 — ERRORS AND INACCURACIES

We may correct genuine errors, inaccuracies, or omissions on our website relating to product descriptions, pricing, promotions, shipping charges, availability, or other information.

Where an error affects an order that has already been placed, we will handle the situation in accordance with applicable consumer law.

SECTION 17 — PROHIBITED USES

You may not use the Services:

For unlawful or fraudulent purposes.
To infringe our rights or the rights of third parties.
To upload content that you do not have permission to use.
To introduce malware, malicious code, or other harmful material.
To interfere with the security or proper operation of the Services.
To impersonate another person or entity.
To send unauthorised spam or other unlawful communications.
In any way that violates applicable Greek or European Union law.

SECTION 18 — AVAILABILITY OF THE SERVICES

We aim to keep our website and Services available and functioning properly.

However, temporary interruptions may occur due to maintenance, technical issues, third-party services, security incidents, or events outside our reasonable control.

We may modify or discontinue parts of the Services where reasonably necessary.

SECTION 19 — LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law, including mandatory consumer protection rights.

To the extent permitted by law, we are not responsible for losses that are:

Not reasonably foreseeable.
Caused by circumstances outside our reasonable control.
Business or commercial losses incurred by a consumer purchasing products for personal use.

Any limitation in these Terms applies only to the extent permitted by applicable Greek and European Union law.

SECTION 20 — INDEMNITY

Where permitted by applicable law, you may be responsible for losses or claims resulting from your unlawful use of the Services or from content that you upload in violation of third-party rights.

This provision does not limit any mandatory rights or protections available to consumers.

SECTION 21 — SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be applied to the maximum extent permitted by law or severed where necessary.

The remaining provisions will continue to apply.

SECTION 22 — NO WAIVER

Failure by ASPECTO to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.

SECTION 23 — GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of Greece and applicable European Union law.

If you are a consumer, nothing in these Terms deprives you of any mandatory protection or jurisdictional rights granted to you under applicable Greek or European Union law.

Any dispute will be handled by the competent courts determined in accordance with applicable law.

SECTION 24 — CHANGES TO THESE TERMS

We may update these Terms where reasonably necessary to reflect changes to our Services, business operations, or legal requirements.

The current version will be published on our website.

Changes will not retroactively remove rights that have already arisen in relation to an accepted order.
